Below is from the courts findings from June 28, 2011 regarding the lawsuit that Kenny Eade brought against a penny stock bulletin board (InvestorsHub.com).
“The Affidavit of Kenneth Eade, and its accompanying exhibits, in Support of Plaintiff’s Opposition to the Special Motion to Strike filed by InvestorsHub.com, Inc. (“iHub”) are rejected in their entirety.”
Meaning: Ken Eade your court filings are REJECTED… ouch!
“First, all papers …..were due to be filed no later than Monday, May 2, 2011.
Plaintiff (aka Ken Eade) did not file the Affidavit of Kenneth Eade until after 8:00 p.m. on Thursday, May 5, 2011.”
Meaning: Ken Eade was late in his filings. Oh Kenny… late again… just 3 days….
“Moreover, Plaintiff (aka Ken Eade) did not timely serve the exhibits referenced in the Affidavit of Kenneth Eade. After two requests on Friday, May 6, 2011, Plaintiff’s office (aka Ken Eade) finally began sending iHub’s counsel PDF copies of the exhibits spread out over 11 separate emails arriving between 7:37 p.m. and 10:35 p.m.
At 5:08 a.m. on Saturday, May 7, Plaintiff asserted that all exhibits had been sent by email the previous night.”
Meaning: Ken Eade did not tell the truth…”the PREVIOUS night”…. Oh Kenny.
“Second, as of the filing of these objections in conjunction with iHub’s reply papers, iHub still has not received conformed copies of the exhibits by proper, formal service. “
Meaning: Ken Eade messed up and didn't do his job.
“Third, the Affidavit should be disregarded because it is not properly referenced and cited in the Opposition brief.”
Meaning: Ken Eade’s documentation is a mess….Oh Kenny.
